Open-End Mortgage Deed

Mortgagor (Borrower): [Name] · Mortgagee (Lender): [Name] Property: [Address/Legal Description] · Maximum Secured Amount: [Amount] · Date: [Date]

1. Grant of Mortgage

Mortgagor grants Mortgagee a mortgage on the property described above, securing repayment of all present and future advances made under [the associated line of credit/loan agreement], up to a maximum principal amount of [Amount] outstanding at any time.

2. Open-End Nature

Unlike a closed-end mortgage securing a single fixed loan, this mortgage secures a revolving or advancing credit facility — Mortgagor may borrow, repay, and re-borrow up to the maximum amount, without needing to record a new mortgage for each advance.

3. Future Advances

All future advances made under the credit agreement are secured by this mortgage with the same priority as the original recording date, to the extent permitted by [applicable state law].

4. Release

This mortgage will be released/satisfied of record when the underlying credit facility is terminated and all amounts owed are paid in full.

5. Default

Default under the underlying credit agreement constitutes default under this mortgage, entitling Mortgagee to foreclose per applicable state law.

Mortgagor signature: ______________________ Date: ____________

Notarization/Recording: This deed must be recorded with the [County Recorder's Office] to be effective against third parties.

*This document is provided for informational and educational purposes only and does not constitute legal advice. Open-end mortgages (common with HELOCs) can secure future advances at the ORIGINAL recording priority in most states — this priority protection for later draws is exactly what makes lenders willing to offer a revolving credit line secured by real property in the first place.*
